5. Client Responsibilities

  • Third-party account access

The client must ensure that any content, images, trademarks, documents, or other materials supplied to Focus & Motive are legally permitted for use.

Delays in providing required information, content, access, or approvals may affect the project timeline.

6. Website Development and Delivery

Website development services are delivered digitally.

Depending on the project, the completed website or related work may be delivered through:

  • Domain or hosting account

  • Email

  • WhatsApp

  • Online communication platforms

  • Other agreed digital methods

The delivery timeline depends on the project scope, client requirements, availability of content and access, revisions, and third-party services.

Any timeline provided by Focus & Motive is an estimated timeframe unless a specific deadline has been expressly agreed in writing.

7. Revisions and Changes

Revisions are handled according to the selected service package or project agreement.

A revision means a reasonable modification to work already included within the agreed scope.

Requests for new features, additional pages, major redesigns, new integrations, or changes outside the original scope may be treated as additional work.

Additional work may require additional payment and may extend the delivery timeline.

8. Client Approval

Before final completion, the client may be given an opportunity to review the work.

The client is responsible for checking the website, content, product information, links, contact details, and other provided information before final approval.

Once the client approves the completed work, further changes outside the agreed revision scope may be treated as additional work.

9. Third-Party Services and Platforms

Some projects may require third-party services or platforms, such as:

  • Domain registrars

  • Hosting providers

  • Payment gateways

  • WhatsApp or Meta services

  • Email services

  • Plugins and applications

  • APIs

  • Other external platforms

These third-party services are generally subject to their own terms, fees, policies, availability, and technical limitations.

Focus & Motive is not responsible for changes, interruptions, restrictions, pricing changes, account suspension, technical failures, or policy decisions made by third-party providers.

Where applicable, the client is responsible for maintaining their own third-party accounts and paying third-party fees unless otherwise agreed.

10. Domain, Hosting, Apps and Other Third-Party Costs

Unless specifically included in a service package or written agreement, third-party costs such as domain registration, hosting, premium themes, applications, plugins, paid APIs, advertising accounts, or other external services are not included in our service fee.

Any third-party cost that is required for a project should be communicated to the client where reasonably possible.

Third-party charges are generally subject to the refund and cancellation policies of the respective provider.

11. Intellectual Property

Upon full payment for a completed project, the client may use the final website work delivered specifically for the client, subject to any third-party licenses, platform terms, or separately licensed materials.

Unless otherwise agreed, Focus & Motive retains ownership of its own pre-existing materials, development methods, reusable components, templates, processes, tools, and general know-how.

Third-party themes, plugins, applications, fonts, images, stock assets, software, and other licensed materials remain subject to their respective license terms.

The client is responsible for ensuring that materials supplied by the client do not infringe the rights of another person or organization.

12. Client Content and Materials

The client retains responsibility for the content and materials supplied for their project.

The client confirms that they have the necessary rights or permissions to use materials provided to Focus & Motive, including text, images, logos, trademarks, videos, documents, and other media.

Focus & Motive may use client-provided materials only as reasonably necessary to provide the requested services.

13. Payments and Failed Transactions

If a payment fails, is reversed, disputed, charged back, or otherwise remains unpaid, Focus & Motive may pause work until the payment issue is resolved.

Where appropriate, we may request confirmation or additional information regarding a payment.

If a customer makes a duplicate payment or an incorrect payment, the matter will be reviewed and handled according to the applicable payment and refund process.

14. Cancellation and Refunds

Cancellations and refunds are governed by our Refund & Cancellation Policy.

Customers should review that policy before purchasing a service.

A refund, where applicable, may depend on whether work has started, the amount of work completed, non-recoverable costs, third-party charges, and the circumstances of the cancellation.

  • Client-provided content or materials

  • Third-party platforms or services

  • Domain or hosting providers

  • Payment gateway issues

  • Changes to external APIs or applications

  • Client account restrictions or suspensions

  • Unauthorized changes made by the client or another third party

  • Delays caused by missing client information or approvals

  • Events outside our reasonable control

Nothing in these Terms is intended to exclude or limit any responsibility that cannot lawfully be excluded or limited under applicable law.
